Absolute Divorce
When a marriage cannot be saved, the state of Arkansas allows a total dissolution of the marriage. The spouse seeking to dissolve the marriage must prove certain grounds required by law. These grounds must be proven with specificity and must be corroborated when the divorce is contested. Arkansas does not grant "no-fault" divorces, but does allow for parties who have lived separate and apart for more than 18 months to obtain a divorce without the necessity of proving any of the other required grounds.
Separation or Divorce from "Bed and Board"
An alternative to a traditional divorce is what is called a "separation from 'bed and board'," in which a Court can grant a temporary division of property and, if applicable, temporary child support and custody of the child or children while the parties live separate and apart.
Post-Divorce
The fact that you have already gone through a divorce that dissolved your marriage does not mean that problems cannot and do not arise even AFTER the divorce. Typical problems relate to the exchange of property pursuant to the parties' settlement agreement and/or divorce decree, payment of child support and expenses, violations of the child custody and visitation arrangements, etc. When the parties' cannot agree on a resolution of a post-divorce issue, the only option is usually to take the other person back to court to have the judge resolve it.
